What section 51.3 requires
As of 2026, section 51.3 treats a person 55 or older as a senior citizen in a senior citizen housing development, one with at least 35 dwelling units; elsewhere the age is 62. Age limits can be no stricter than requiring one senior in residence in each home, with every other resident a qualified permanent resident, a permitted health care resident or a person under 55 the law allows. At the least, the people beginning any occupancy must include a senior who intends to live there permanently as a primary residence.
A qualified permanent resident lived with the senior beforehand and was 45 or older, or a spouse, cohabitant or person giving primary physical or economic support, and may stay on after the senior’s death, hospitalization, other prolonged absence or the end of the marriage. Guests under 55 must be allowed for periods the documents set, at least 60 days a year. If an age rule in the documents differs from 51.3, Civil Code 4525 makes the seller state that it is enforceable only as far as 51.3 permits. Read the CC&Rs before contingencies end.
