Ojai new construction at a glance

  • Mostly backyard units lately: New homes for sale in Ojai CA arrive slowly. The City’s 2021-2029 Housing Element, adopted May 2023, reports 63 units approved in 2021 and 2022: 59 ADUs and junior ADUs, 15 of them through a compliance program, plus four single-family houses.
  • A 53-unit target: The plan covers the City’s 53-unit regional allocation for 2021 to 2029, and California’s housing department found it in substantial compliance on August 10, 2023.
  • Growth allotments on hold: The City’s Residential Growth Management Plan (Ordinance 769, 2004) caps yearly residential allotments, but the May 2023 Housing Element says state law suspends it through January 1, 2030, and plans to resume it then unless the City revises or drops it.
  • County boundaries stay put: On County land, the Ojai Valley Area Plan bars outward expansion of Existing Community boundaries, puts farmland outside its Existing Community and Rural areas in Open Space with 10- to 80-acre minimum parcels, and steers development in the City’s sphere of influence toward annexation.

Fees, special taxes and fire clearance

The Housing Element’s fee table, from the City’s 2019 fee schedule, lists school, traffic mitigation and park fees and leaves water and sewer terms to the districts. Casitas Municipal Water District formed CFD 2013-1 (Ojai), a Mello-Roos district, to buy and improve the Ojai Water System; a 2021 District memo says parcels issued building permits in that system join its special tax roll each year, and the County’s 2025-26 roll bills 2,626 parcels. Ask whether a lot is in it. In the Area Plan’s high and very high fire hazard areas, the County requires a fuel break of at least 100 feet around combustible structures.

Papers a builder owes

Civil Code 912, part of California’s SB 800 rules, has the builder hand the first buyer its maintenance guidance, product warranty papers and its own limited warranties at the initial sale, record a notice on title about these claim procedures, and tell that buyer to pass the papers on. On a nearly new resale, ask the seller for that packet.

Ojai new home questions, answered

Do backyard units count against the growth limit?

No. A 2013 amendment exempted ADUs and home splits from the growth ordinance, and the Housing Element counts 120 potential ADUs toward its 2021-2029 sites. The zoning tables still say other new homes may need a growth allocation, though that Housing Element treats the ordinance as suspended until 2030.
